Abstract

As one type of the new medium for the 21st century’s public to articulate their views, network public opinion is playing an ever increasingly important role in the public sphere. Taking as case studies the internet responses to the Wenzhou bullet-train collision and drawing from insights and methodologies of sociology of law, this paper seeks to examine the myriad aspects of network public opinion. Based on a critical review of internet responses to the Wenzhou bullet-train collision, it first analyzes the constitutive mechanisms of the functions of network public opinion from insights of public sphere theory and media field theory. It then centers, from perspectives of sociology of law, on the optimization of the modes of functions of network public opinion from both the micro and macro angles. The paper argues that to better benefit from network public opinions, it is imperative to optimize relevant legal frameworks and legal principles, and ultimately, to realize system innovations in responsive government system, social control, network media field as well as the socialization of law.
