Abstract

This commentary discusses five recent decisions on procedural matters handed down by the trial chambers of the International Criminal Court (ICC). The cases address four major issues: the first concerns the timing of admissibility challenges, the second addresses witness protection practices and disclosure issues more broadly, the third details the role and participation of victims and their representatives in trial proceedings, and the fourth delineates the place and role of judicial questioning during proceedings. Each of the specific decisions is discussed in turn and this commentary highlights the importance of the decisions for the functioning of the ICC and its significance for the development of international criminal law more broadly.
