Abstract

It is no great secret that conversion has always been a somewhat problematic and unpopular tort, and indeed it has often faced criticism and calls for reform. None more so than when questions arise about how conversion fits, or could adapt to fit, the modern world. This occurred in light of the OBG decision in the mid-2000s and is once again coming to the forefront following the Law Commission's Digital Asset Consultation and Report which questioned, in part, how conversion might apply to digital assets. This discussion raises some questions about the suitability of conversion more generally, and what any proposals to edit conversion for digital assets might mean for conversion outside of the scope of digital assets. This paper seeks to engage with these questions and think about the future of conversion.
