Abstract

This chapter examines feminist approaches to criminal law, with special emphasis on the considerable success of feminist projects in domestic, international, and transnational criminal law. The chapter begins by sketching the extensive points of contact between feminists and the criminal law at the domestic level particularly in relation to rape, domestic violence, and battered woman syndrome. It then turns to feminist interventions in international criminal law to address war-time rape as well as in transnational criminal law, particularly on human trafficking. Assessing feminist successes in criminal law in terms of governance feminism, the chapter ends with thoughts for how feminists might further their critique of criminal law rather than merely expand their project in criminal law.
