Abstract

Reviews the operation of fact-finding in divorce cases in which one parent implacably opposes the other's continued contact with their child. Examines the approach of English courts to drawing inferences regarding the risk of harm to a child, the reasoning applied in case law, and how the factual basis for inferring a risk of harm is established, including the approach to hostility to contact which is factually underpinned but not justified.
