Abstract
This paper makes an attempt to contribute to the literature on pandemic recovery and sustainable development from an insurance perspective.
The interpretation of business interruption (BI) insurance policies vis-à-vis pandemic-related losses is imperative in shaping business assureds’ post-pandemic recovery. Section 12.2, therefore, analyses not only the seminal case, The FCA v Arch Insurance (UK) Limited and Others ([2020] EWHC 2448 (Comm); [2021] UKSC 1) which has been said to widen the scope of coverage, but also the subsequent BI English cases which continue to occupy the courts. These highlight the shortcomings of the test case and continue to shape business assureds’ post-pandemic recovery.
Section 12.3 analyses the role of insurance in shaping sustainable development, post-pandemic, as the world works towards attaining ‘Agenda 30.’ Focussing on SDG 3, this paper considers (i) how insurance can be better utilised to promote access to vaccines for all, i.e. in remote corners of the world, and (ii) the role of insurance in promoting universal health coverage. To this end, it takes Uganda as a case study, where health reforms are currently being debated for implementation, and considers how social insurance could be utilised to promote this goal.
