Abstract
Effective control of cross-border practices in market-economy regimes whose borders have to remain open to goods, capital and services if those regimes are to remain viable, is nearly impossible. The article shows the tensions between a legal system predicated on openness and a groundswell of security-driven rhetoric justifying coercive and ostracizing practices against foreigners.
