Abstract

Blackman has been cleared of murder, but he was not acquitted. The finding of manslughter on the grounds of diminished responsibility takes into account some of the contextual factors omitted in the first trial, but also makes clear that while the battlefield is an extraordinary place, it is not an area free from legal responsibility.
